By using this product you agree to observe all instructions, information and warnings contained in this documentation.

References in this help documentation to “the product” include the Sentry software and any hardware supplied by Maptek or its affiliates for use with the software (including any laser scanner).

Exception conditions

A range of conditions may affect the performance of the product, some examples of which are set out below. Maptek and its affiliates will not be responsible for liability resulting from these conditions. This list is not exhaustive and does not limit the terms of the EULA:

  1. use of the product other than under conditions of normal use and strictly in accordance with the EULA and the Operator Manual (including refraining from using any product that has been subject to damage or suspected damage such as accidents, impacts, electrostatic shocks, flashes, fire or other causes of damage, and not using or storing products outside specified temperature range limits);

  2. use of the product in a manner or for a purpose not reasonably contemplated or not authorised by Maptek;

  3. use of the product in combination by any means and in any form with other products, software, goods or items not specifically approved by Maptek (or not complying with specifications recommended or required by Maptek);

  4. any fault, defect, malfunction or interruption in the operator’s equipment or physical or electronic network or computing environment, or any telecommunications or power supply network;

  5. an error in or modification of products other than the product (including third-party hardware or software such as the operating system);

  6. any virus or malicious or damaging third-party code;

  7. failure to ensure current available product updates are installed;

  8. a force majeure event or any other cause within the reasonable control of the operator and outside the reasonable control of Maptek; or

  9. modification or alteration of the product (including opening the product or additions made to the product) without the prior written consent of Maptek.

Product use

The product is designed to assist in detecting changes in a monitored surface in a physical environment to monitor the stability of a site. The product is a tool intended for use only as an aid for that purpose. No such tool is completely infallible, and the accuracy and reliability of the product may be affected by a range of factors (which may include for example latent site conditions, faults or interruptions in telecommunications or power supply networks, faults in hardware or other equipment, or operator error such as incorrect set-up or configuration of the product). The stability of a monitored site may change at any time due to a range of environmental factors and potentially without warning. Accordingly, while the product may be used to monitor a site for safety purposes, it should not be relied upon as the sole means of ensuring the safety or security of property or personnel. Other supporting strategies and technologies may be required to assist in continuous monitoring and assessment of site hazards.

All persons using the product do so at their own risk. The user (who has licensed the software from Maptek) accepts sole responsibility for use of the product (including by any person to whom the user makes it available) and for the safety of all associated operations, property and personnel, and Maptek and its affiliates accept no responsibility for any injury, damage, loss or other liability that may arise in connection with use of the product.

Specifically, but without limiting the above, Maptek and its affiliates accept no responsibility for events such as rock falls, landslides or ground movement that may occur during use of the product, irrespective of whether the product has been used and is operating correctly or not.

The assessment of stability conditions must be undertaken by skilled and certified operators who understand the data supplied by the product and all other factors relevant to forming an appropriate assessment of physical changes and potential risks.
