Warranty certificate

Maptek (hereafter referred to as the Supplier) warrants that at the time of sale to the Customer, the scanner will be in substantial accordance with the sales documentation supplied to the Customer for the duration of the warranty period.

Warranty period

The Product is provided with a twelve (12) month product warranty with the exception of the XR3 and UR3 scanner variants that are provided with a twenty-four (24) month warranty, subject to being serviced in the first year. Peripherals associated with the scanner are warranted for a period of twelve (12) months.

Application

If during this warranty period the Product is found to be defective in materials and/or workmanship and if the Customer notifies the Supplier of the defect within the warranty period specified in this paragraph, the Supplier will rectify, or if necessary to remedy the defect, replace the Product, at its own expense. This remedy, excluding freight costs back to the Supplier, will be the total liability of the Supplier.

This warranty shall not apply if:

  1. the Product is not used in accordance with the Supplier’s instructions,

  2. the Product is not returned to an authorised Maptek Service centre in the case in which it was originally supplied,

  3. any part of the Product has been altered, modified, converted or tampered with by the Customer or any other unauthorised party without the written approval of the Supplier,

  4. the Product was purchased from a party other than an authorised Maptek Reseller,

  5. any of the Product’s shock load sensors indicate extreme rough handling,

  6. damage or wear is caused by any of the Customer’s equipment malfunctioning,

  7. damage or wear is due to any other cause within the control of the Customer that results in the Product becoming inoperative, or

  8. the Product is not returned to an authorised Service centre in the case in which it was originally supplied, for service and maintenance at recommended intervals at the Customer’s expense.

Warranty Disclaimer

  1. All freight costs associated with the return of the product to an authorised service centre for assessment and repair shall be borne by the Customer. In the event that repairs are deemed to be outside of the Supplier liability under this warranty all freight and handling costs associated with the return of the product to the Customer are to be borne by the Customer.

  2. The foregoing is the only warranty made by the Supplier in relation to the product. The Supplier specifically disclaims all other warranties, express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability and fitness for a particular purpose and non-infringement of third parties’ rights.

  3. This warranty applies to the original Customer only and is not transferable.

  4. Limitation of liability:

    1. No action, regardless of form, arising out of the transactions under this warranty may be brought by either party against the other more than one (1) year after such party knew or should have known of the occurrence of the events which gave rise to the cause of action.

    2. Parties expressly exclude liability to the other party for economic loss (including but not limited to loss of profits, business revenue, goodwill, or anticipated savings) and for any other consequential loss claimed to have resulted from or be in any way related to the marketing, supply, implementation or support of the product or documentation and whether arising from negligence or howsoever.

    3. It is intended by both parties that the foregoing exclusions of liability shall be reasonable as between the Supplier and Customer, but in the event that any or all of the foregoing exclusions shall be held to be invalid for any reason, or either party shall otherwise become liable to the other for loss or damages, such liability shall not under any circumstances exceed the aggregate amount of original purchase cost.
